I, Dr. Herman J. Weinreb died suddenly on April 14, 2000. My life insurance policy should have been available to my widow through my employer, the Hospital of Joint Diseases in NYC (part of NYU Medical Center). The hospital denied that I had ever signed an enrollment form for what was supposed to be life insurance at 2.25 times salary. The hospital never provided an SPD because they never wrote one -- too busy with their merger. My widow sued. It took 5 years of litigation and in the end the Second Circuit Court of Appeals decided against her and me. They decided to speak for the dead: said I should have filled out the enrollment form. Of course, I could not be there in person to protest. I AM DEAD. They also said that the hospital's lack of an SPD was a "harmless error." It was not harmless nor an error. In fact, in the course of discovery the hospital's records showed systematic defrauding of its doctors. Doctors were receiving far less in benefits than their positions and/or contracts called for.
